Terms of Service

Welcome to Launcharr. These Terms of Service ("Terms") govern your access to and use of the Launcharr platform, website, and related services (collectively, the "Service") operated by Launcharr ("we", "us", "our"). By creating an account or using the Service you agree to be bound by these Terms.

1. Use of the Service

Launcharr provides software that helps you generate launch copy, distribute content across channels, and track results. You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account and for keeping your credentials secure.

You agree not to:

• Use the Service to send spam, harass, or otherwise harm third parties.
• Reverse engineer, copy, or resell any part of the Service.
• Attempt to bypass usage limits, billing, or security controls.
• Use the Service to violate any applicable law, regulation, or third-party platform policy.

2. Accounts

To use most features you must create an account and provide accurate information. You are responsible for any content you submit and any actions taken through your account. We may suspend or terminate accounts that violate these Terms.

3. Payment Terms

Paid plans are billed in advance on a recurring monthly basis at the price listed at checkout. By subscribing you authorise us and our payment processor to charge your payment method each billing cycle until you cancel. Prices may change with at least 30 days' notice; changes will not apply retroactively to your current billing period.

4. Cancellation

You may cancel your subscription at any time from your account settings or by emailing hello@launcharr.io. Cancellation takes effect at the end of your current billing period and your access continues until then. Refunds are governed by our Refund Policy.

5. Intellectual Property

The Service, including all software, designs, logos, and content created by Launcharr, is owned by Launcharr and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

You retain ownership of content you submit to the Service ("Your Content"). You grant Launcharr a worldwide, royalty-free licence to host, process, and display Your Content solely to operate and improve the Service.

6. Third-Party Services

The Service integrates with third-party providers (such as hosting, AI, automation, payment, and messaging services). Your use of those features is also subject to the terms of those providers. We are not responsible for the availability or actions of any third-party service.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific marketing, growth, or revenue outcomes from using the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Launcharr and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Launcharr from any claims, damages, or expenses arising from your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access at any time if you breach these Terms or if continued provision of the Service is not commercially viable. You may stop using the Service at any time by cancelling your account.

11. Changes to These Terms

We may update these Terms from time to time. If changes are material we will notify you by email or in-app before they take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Launcharr is established, without regard to its conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.
